Sapna Choudhary Granted Interim Protection in Domestic Violence Case

A Delhi court has granted interim protection to famous Haryanvi singer and Bigg Boss celebrity Sapna Choudhary (33), based on Choudhary's application made under the Protection of Women from Domestic Violence Act. The Delhi Judicial Magistrate Nidhi Singh issued the order on Tuesday, prohibiting Choudhary's husband from contacting, approaching, or visiting Choudhary's residence or workplace until the next hearing. Choudhary obtained interim relief because she felt there were immediate threats to her personal safety and disruptions to her professional activity from her husband's actions, according to an application made to the Mahila Court through her lawyer, Preeti Singh. Choudhary's petition cited multiple previous assaults by her husband on her and his causing of public disturbances. Choudhary left their common bedroom and then filed a formal domestic violence complaint against her husband.

In addition, the court order provides that, "Respondent (Choudhary's husband) is hereby restrained from approaching Petitioner in any manner until the next date of hearing. Respondent is restrained from contacting Petitioner in any manner or visiting her place of residence or work, and from committing any act of domestic violence, until NDOH (next date of hearing)." In considering Choudhary's application, the magistrate considered a number of circumstances that justified prompt action.

Choudhary's attorneys argued that she required an urgent protective order so that she could safely attend the world premiere of her new motion picture, without interference from her estranged husband. The petition stated that if Choudhary were not granted temporary relief, such would expose her to irreparable damage, demean her and jeopardize her ability to meet her professional obligations.

After considering significant documentary evidence submitted by the petitioner and her counsel, the Judge concluded that sufficient facts existed to support the issuance of the protective order. In reaching this conclusion, the Judge conducted a detailed review of, among other things, photographic evidence depicting the injuries that were allegedly sustained during the domestic violence incidents and electronic evidence submitted by Choudhary's counsel. The photographic and electronic evidence provided the basis for the Judge's granting of temporary protective orders to the Petitioner.

The judicial magistrate also instructed the protection officer and the local station house officer assigned to handle the domestic violence case to ensure that they comply with the Court's Orders and provide any assistance necessary to the Petitioner. The two officers have been charged with monitoring compliance with the restraining order and ensuring the Petitioner's safety while the actions are pending. Choudhary and her husband entered into a civil partnership on 21 December 2020 after being in a relationship for 4 years. They have two children together.
