Robinsons files legal action against Aldi, claiming trademark infringement over drink packaging.
In a high-profile trademark dispute, Robinsons has taken legal action against Aldi, accusing the discount supermarket giant of infringing on its trademark with the design of Aldi’s Sun Quench Squirty Squash. The case, filed in the High Court on March 19, 2025, involves claims of trademark infringement and passing off, with Robinsons alleging that Aldi's product closely resembles its own well-established squash drink, Robinsons Mini.
Robinsons, represented by the intellectual property law firm Stobbs, has brought attention to what it describes as the striking visual similarities between the packaging of the two products. Legal experts, including Kirsten Gilbert from Marks & Clerk, have pointed out the resemblance in the overall design, including the font, colors, and style used in both brands' packaging.
This legal battle is not the first time Aldi has found itself embroiled in a dispute over alleged product copying. In January 2025, Aldi successfully defended itself in a trademark case against Thatchers, a drinks company that accused the retailer of replicating one of its products. Additionally, in 2022, Aldi settled a legal row with Marks & Spencer over its Colin the Caterpillar cake, with M&S accusing Aldi of mimicking its iconic dessert design.
Although Aldi has yet to comment publicly on the current lawsuit, the outcome of this case could have broader implications for trademark law and the competitive landscape of the grocery industry. Robinsons, a well-known British brand, is determined to protect its intellectual property, and this legal action underscores the importance of branding and design in the highly competitive drinks market.
With ongoing trends of legal disputes over design infringement, retailers and manufacturers alike will be watching closely to see how this case unfolds.
