MahaRERA introduces a new regulation requiring developers to submit and publish a Quality Assurance Certificate to improve construction quality and transparency.
Maharashtra Real Estate Regulatory Authority (MahaRERA) has brought in a new regulation that ensures protection for homebuyers, who will now see better quality of construction and transparency across the real estate sector. Developers shall submit a 'quality assurance certificate' at the end of the year. It shall also publish the same on its websites.
This decision was taken after consulting with stakeholders and is part of an amendment to the MahaRERA General Regulations, 2017, which was officially published in the government gazette. The primary aim of this initiative is to minimize reliance on the defect liability clause, which obligates developers to correct deficiencies in homes within five years of possession. The regulation tries to reduce the need for rectifying issues post-occupancy by focusing on quality assurance and enhancing the overall quality of housing.
The Quality Assurance Certificate will evaluate critical factors such as structural design, stability, fire safety, the materials used, and the workforce's skill level. It will also consider the results of various quality tests conducted throughout the construction process. Developers must document and verify these elements with the help of project engineers and supervisors before making the certificate public.
In addition, the regulation requires that soil testing, structural engineering appointments, and Bureau of Indian Standards (BIS) compliance be recorded for certification. Independent third-party quality checks, when performed, must also be verified and certified.
According to Ajoy Mehta, chief of MahaRERA, this is a major leap in enhancing construction quality in the state of Maharashtra. The developer will be incentivized to bring best practices, knowing that the credibility is being tied to the quality of the homes being delivered, thus homebuyers stand to benefit through better quality homes.
