What is the Lemon Law in California?
The California Lemon Law, formally known as the Song-Beverly Consumer Warranty Act, was enacted in 1970 to protect consumers who purchase or lease defective vehicles. Under this law, a vehicle is considered a "lemon" if it has major defects that affect its use, value, or safety and cannot be repaired after a reasonable number of attempts. Under the Lemon Law, manufacturers are obligated to replace or buy back these defective vehicles, thus protecting consumers from faulty products.
Qualifying Criteria Under Lemon Law
Defects Under Warranty: The problem with the vehicle has to arise when it is still within the warranty of the manufacturer.
Manufacturer Notice: The consumer must give notice to the manufacturer or an authorized repair shop regarding the defect and give the opportunity for repairing the defect.
Reasonable Number of Repair Attempts: The statute permits a "reasonable number" of attempts to repair. Typically, this is defined as four attempts for the same defect or two attempts for a safety-related defect.
Unable to Cure: If the manufacturer cannot cure the defect within the warranty period, the vehicle may be a lemon.
What Vehicles Are Covered?
Compact, mid-size, and full-size cars
Light trucks, SUVs, and vans
Motorhomes, dealer demo vehicles, and personal vehicles used for family purposes
Some commercial vehicles purchased or leased for business use
However, the following vehicles are not covered under California's Lemon Law, for example, motorcycles used primarily for off-road purposes, and business vehicles weighing more than 10,000 pounds.

Replacement vehicles if the car cannot be repaired
